सुप्रीम कोर्ट ने पिछले सप्ताह अपने इस फैसले में कहा कि नियोक्ता अब सर्विस बॉन्ड लागू कर सकते हैं। कंपनियां इसमें कर्मचारियों के लिए एक न्यूनतम कार्य अवधि तय कर सकती हैं और समय से पहले नौकरी छोड़ने वाले कर्मचारियों से प्रशिक्षण लागत वसूल सकती हैं। इसे देश के अनुबंध कानून का उल्लंघन नहीं माना जाएगा।

क्या है मामला?
विजया बैंक के एक कर्मचारी प्रशांत नरनावरे को तीन साल की अनिवार्य सेवा पूरी किए बिना नौकरी छोड़ने पर 2 लाख रुपये ‘लिक्विडेटेड डैमेज’ (जुर्माना) के रूप में चुकाने के लिए कहा गया था। इसके खिलाफ उन्होंने कर्नाटक हाई कोर्ट में अपील की थी। हाई कोर्ट ने नरनावरे के पक्ष में फैसला सुनाते हुए उस आदेश पर रोक लगा दिया था। अब सुप्रीम कोर्ट ने 16 मई के अपने आदेश में कर्नाटक हाई कोर्ट के इस फैसले को पलट दिया।

कोर्ट ने अपने आदेश में कहा, “नियोक्ता-कर्मचारी संबंध, टेक्निकल डेवलपमेंट, काम की प्रकृति, रीस्किलिंग और एक मुक्त बाजार में विशेषज्ञ कार्यबल को बनाए रखने जैसे मुद्दे अब सार्वजनिक नीति के क्षेत्र में उभर रहे हैं। इन्हें रोजगार अनुबंध की शर्तों का मूल्यांकन करते समय ध्यान में रखा जाना चाहिए।”

सुप्रीम कोर्ट ने अपने आदेश में कहा कि विजया बैंक की नियुक्ति पत्र में दिया गया सर्विस बॉन्ड “व्यापार पर रोक” नहीं है, जो कॉन्ट्रैक्ट एक्ट की धारा 27 के तहत प्रतिबंधित है।
